Drink-Driving Allegations in the UAE: Evidence, Procedure and Legal Support
An allegation of driving after consuming alcohol can lead to arrest, a police investigation, Public Prosecution proceedings and consequences for a driving licence. The applicable federal framework is Federal Decree-Law No. 14 of 2024 on Traffic Regulation, which has been in force since 29 March 2025. The evidence, the alleged conduct and the law applicable on the incident date must be checked before advice is given.
This page provides general information. It does not predict a result and does not replace advice on the police and prosecution records in a particular matter.
What to do after a stop, arrest or summons
Do not drive again if you have consumed alcohol or taken a substance that may affect your ability to drive. If an incident has already occurred, keep the documents and information that may help a lawyer understand the sequence of events:
- the police station, incident or report number;
- the location and approximate time of the stop or collision;
- copies of any summons, release document, test record or driving-licence notice;
- the names and contact details of passengers or other witnesses;
- available dashcam footage, photographs, location data or parking records;
- details of any prescribed medication, including the prescription and packaging; and
- any information about injury or property damage.
Records should be preserved in their original form. Do not edit recordings, delete messages or ask another person to provide an inaccurate account. If you do not understand a document or question, request an explanation or appropriate language assistance before signing.
The current UAE traffic-law framework
The 2024 Traffic Regulation Decree-Law addresses driving or attempting to drive while under the influence of alcohol. It also gives traffic-control officers powers in specified circumstances and provides for criminal and driving-licence consequences. The precise allegation and potential outcome depend on the charge, the evidence, any collision or injury, the person’s driving record and the court’s application of the law.
It is not safe to infer the legal position from a marketing phrase such as “zero tolerance” or from a blood-alcohol limit used in another country. The prosecution file and the current UAE provisions should be reviewed together. Alcohol allegations and allegations involving narcotic or psychotropic substances are also not interchangeable; the decree-law treats them separately.
Evidence that may require review
A proper assessment starts with the official record rather than assumptions. Depending on the case, relevant material may include the traffic officer’s observations, the reason for the stop, the timing and type of any test, the laboratory or technical record, statements, CCTV or dashcam footage, vehicle data, medical records and evidence of a collision.
A lawyer may consider whether the material identifies the driver and vehicle, records the time sequence clearly, supports the alleged impairment and was collected and documented in accordance with the applicable procedure. A question about a test or record does not automatically invalidate the case; its significance depends on the complete file.
From police investigation to court
The usual path can include a police investigation followed by referral to the Public Prosecution. The prosecution may question the accused, review the evidence and decide the next procedural step. If the matter is sent to court, the court considers the charge, evidence and submissions before issuing a decision. Review or appeal rights depend on the type of decision and the procedural deadlines that apply to it.
Release, bail, licence restrictions, vehicle measures and hearing dates are case-specific. No fixed three-to-six-month period can be promised. A person should follow every official notice and obtain prompt advice about any deadline appearing in the file.
Driving-licence, employment and residency concerns
Traffic proceedings may affect a driving licence, and a collision can create separate insurance or civil issues. Employment consequences depend on the person’s role, contract and regulatory duties. Residency or deportation questions require separate analysis of the charge, classification, sentence and applicable immigration and penal provisions; deportation should not be described as automatic merely because a traffic allegation has been made.
Where the accused is not a UAE national, counsel can identify which issues belong to the traffic case and which require distinct immigration or employment advice.
Arabic proceedings and document review
Official criminal proceedings and court records are generally in Arabic. Accurate review may therefore require the Arabic police and prosecution documents rather than an informal summary. Where a supporting document is in another language, ask whether a legally acceptable translation is required. Interpretation or translation arrangements depend on the authority and procedural stage.

Frequently asked questions
Is drink-driving dealt with only under the UAE Penal Code?
No. The current federal Traffic Regulation Decree-Law specifically addresses driving or attempting to drive while under the influence of alcohol. Other laws may become relevant where there is an accident, injury, death, property damage or a separate offence.
Does any test result automatically prove the charge?
The meaning of a result depends on the type of test, the timing, the official record and the other evidence. The complete file should be reviewed before conclusions are drawn.
Can a lawyer obtain the file immediately?
Access depends on formal appointment, the investigation stage, the authority’s procedure and any applicable restriction. A power of attorney does not by itself guarantee immediate access to every record.
Can a licence be suspended?
The traffic law provides for driving-licence consequences. The applicable measure depends on the allegation, procedural stage, decision and the person’s record.
How long will the case take?
There is no reliable universal duration. Timing varies with the investigation, testing or expert evidence, hearings, service of notices and any review or appeal.
What should I bring to a consultation?
Bring identification, the police or case number, all notices and release documents, any available test or medical record, the driving-licence notice and a factual timeline. Do not send altered evidence or guess at missing facts.
