Embezzlement allegations in the UAE

An allegation described as embezzlement requires an assessment of how property or funds were entrusted, what use was authorised and what conduct is alleged. The term alone does not establish the legal offence.

Accounting discrepancies, disputed payments and an alleged misuse of entrusted assets must be examined against the records and applicable law. The assessment should distinguish a criminal allegation from a contractual or accounting dispute.

Understanding the allegation

The UAE Crimes and Penalties Law is an important starting point for assessing alleged misuse of entrusted property. The relevant provision depends on the person’s role, the basis on which the assets were held and the alleged conduct.

Records that may matter

  • Contracts, appointment documents and delegated authorities.
  • Bank statements, ledgers, invoices and reconciliation records.
  • Approvals for payments, withdrawals or transfers.
  • Correspondence explaining the purpose of a transaction.
  • Audit materials and records of any internal investigation.

Assessing a discrepancy

A missing balance or irregular entry requires explanation, but does not by itself establish every element of a criminal offence. The review should address the transaction, authority, supporting documents and evidence concerning the alleged conduct.

How we assist individuals

We review the complaint and records, identify gaps or inconsistencies and discuss the legal and procedural response appropriate to the matter.

How we assist businesses

We can review the material supporting an alleged misuse of funds, identify further records needed and advise on the distinction between recovery issues and a criminal complaint. Evidence should be preserved without altering the original records.
